The judicial proceedings against Jean Andrés Pumarol Fernández, accused of causing the death of Yolanda Handal Abugabir and injuring five other people during a white-weapon attack in a Naco facility, will continue on Tuesday, October 13, with the start of the trial.
The hearing is scheduled for 9: 00 in the morning before the First Collegiate Court of the National District, composed of the Gisselle Méndez, Giselle Naranjo and Tania Yunes.
The case comes to this stage after the second Criminal Chamber of the National District Court of Appeal overturned the court decision that had favored the accused with a decision of no avail, which prevented him from facing a trial for the facts attributed.
The revocation took place following the appeals submitted by the Public Prosecutor & apos; s Office, represented by the prosecutor Marie Daniela Fernández, and the victim & apos; s relatives, who participated in the proceedings as complainants and civil actors.
In considering the appeals, the court of appeal found that the evidence provided by the prosecution was sufficient to justify the opening of a substantive trial, which should establish the criminal responsibility of the accused.
This decision has resulted in the annulment of Criminal Resolution No. 063-2026-0064, issued on 17 March 2026 by the Seventh Court of the National District Instruction, by which the order of no place had been issued.
In addition to ordering that the case be known in trial, the court imposed three months of pre-trial detention against Pumarol Fernández, a measure that it is serving at the Anamuya Correction and Rehabilitation Centre, located in Higüey, La Altagracia province.
